This agreement is between “Client Signing” and Emily Crump Photography, hereinafter referred to as the "Client Signing", and Emily Crump, hereinafter referred to as the "Photographer(s)".

PERFORMANCE OF SERVICES: Photographer agrees to take photographs per clients request, allowing for artistic expression. Photographer agrees to create high quality photographs ideal for web display or print. Photographer will use professional editing to edit digital images to represent Photographers artistic style. Photographer agrees to provide a digital preview within 14 days of session date unless stated otherwise in writing.

PAYMENT: Client agrees to pay upon date of session the final amount due. In return Emily Crump agrees to provide 15-20 images (full sessions) within 4 weeks time (full sessions). For Mini Sessions (Holiday Mini Sessions) Emily Crump agrees to provide 10-12 images (full sessions) within 2 weeks time. Emily Crump agrees to provide preview of images and print and product pricing for image purchase. Photographer agrees to provide session fee details before signing of this document.

DEPOSIT: At the time of booking client agrees to pay an non-refundable session fee amount to secure session date. The deposit amount will be applied towards the session fee for photography services.

CANCELLATION POLICY: All deposit fees are non-refundable. A notice of 48 hours must be given for cancellation of this contract by the client. Any cancellation made with less than 48 hours will result in full payment by the client. If cancellation is initiated by the Emily Crump, all monies INCLUDING the deposit fee will be returned within 3 business days from the time of cancellation. TRAVEL: Emily Crump agrees to perform photography services within 15 amount of miles of Tomball, TX (77377) city center. Any mileage above 15 miles distance will be charged at $0.60 per mile.

WORK PRODUCT OWNERSHIP: Any copyrightable works, ideas, discoveries or products (ie - “the work”) remain under the ownership of Emily Crump. Under no circumstances does this ownership transfer to the client.

PRINT PRODUCT ORDERING: All sales of products (ie prints, albums, digital images, etc) are final. Once client has ordered and payment has been made, there are no refunds or returns. All images are printed at a professional lab of the Emily Crump’s choosing.

IMAGE ARCHIVE: All images will be available for purchase and/or download for 8 weeks following the session date. After 8 weeks images may be purged from the hard drive and no longer available for access. Photographer may retain certain images for promotional purposes. Photographer is not responsible for storing images beyond the 8 week period. MODEL RELEASE: Photographer requires clients to sign a model release for the purpose of using images for future marketing purposes or for display in their portfolio whether in print or online.

LIABILITY: Emily Crump is not responsible for any damage to person(s) or property during photo session. Client signing is responsible for their own children and their safety. Client releases Emily Crump of any and all liability.

INDEMNIFICATION: Client agrees to indemnify and hold harmless Emily Crump from any claims, losses, fees, attorney fees, costs and judgements against Emily Crump that result from acts or ommission of the client, client’s family members or any acting agent of the client.

GOVERNING LAW: This contract shall be governed by the law of the state of Texas
